El viernes pasado (22/8) participamos, junto a otras colegas y psicólogas, en un conversatorio en el Colegio de Psicólogos, donde propusimos un intercambio de saberes entre dos discursos que se cruzan y, muchas veces, también se tensionan: el jurídico y el psicológico.
¿Qué busca el Derecho? Certezas, orden, dispositivos normativos que resuelvan el conflicto.
¿Qué busca la Psicología? Introducir la subjetividad, abrir preguntas, acompañar procesos más allá de la literalidad de la demanda.
Uno de los momentos más ilustrativos surgió en el debate cuando se mencionó:
— “Cuando un juez me dice qué debo hacer en mi informe, yo podría responderle: yo no le digo a usted qué sentencia dictar”.
En la ironía hay una verdad que no podemos eludir: cada disciplina tiene su lógica, su campo, y su límite.
De allí la importancia de comprender:
- Que el sujeto de derechos y el sujeto en proceso no siempre coinciden.
- Que la pretensión procesal no agota la demanda latente.
- Que la certeza jurídica convive con la incertidumbre subjetiva.
El desafío es este: aprender a dialogar entre disciplinas para que el quehacer judicial no se reduzca a un trámite, ni la intervención psicológica quede atrapada en un mandato. Porque en el punto de cruce entre la normatividad jurídica y la significación subjetiva se juega lo más importante: la dignidad de las personas.
